    1. Agreement to Terms

    By accessing or using the services provided by Upscale Detailz LLC ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

    2. Services Description

    Upscale Detailz provides professional automotive detailing services including, but not limited to, ceramic coating, paint correction, interior and exterior detailing, and related automotive care services. All services are performed at our facility located at 9535 East Doubletree Ranch Rd. Suite 140, Scottsdale, AZ 85258.

    3. Booking and Appointments

    3.1 Scheduling

    Appointments must be scheduled in advance. We reserve the right to refuse service or cancel appointments at our discretion.

    3.2 Cancellation Policy

    Cancellations must be made at least 48 hours prior to the scheduled appointment. Cancellations made with less than 48 hours notice may be subject to a cancellation fee of up to 50% of the service cost. No-shows will be charged the full service amount.

    3.3 Rescheduling

    Rescheduling requests must be made at least 24 hours in advance and are subject to availability.

    4. Payment Terms

    4.1 Pricing

    All prices are subject to change without notice. Quoted prices are estimates and may vary based on the actual condition of the vehicle and services required.

    4.2 Payment Methods

    We accept cash, credit cards, and other approved payment methods. Payment is due upon completion of services unless other arrangements have been made in advance.

    4.3 Deposits

    A deposit may be required for certain services. Deposits are non-refundable unless we cancel the appointment.

    5. Vehicle Condition and Liability

    5.1 Pre-Service Inspection

    We conduct a thorough inspection of your vehicle before service. Any pre-existing damage will be documented. Customers are responsible for disclosing any known issues or concerns with their vehicle.

    5.2 Liability Limitations

    While we take utmost care in handling your vehicle, we are not liable for:

    • Pre-existing damage, wear, or defects
    • Damage caused by defective paint, clear coat, or factory defects
    • Loss or damage to personal items left in the vehicle
    • Damage from circumstances beyond our control (natural disasters, theft, etc.)
    • Issues arising from previous poor quality work by other detailers

    5.3 Insurance

    Our maximum liability for any claim is limited to the amount paid for the specific service in question. We maintain general liability insurance, but customers should verify their own insurance coverage.

    6. Customer Responsibilities

    Customers are responsible for:

    • Providing accurate vehicle information and disclosing any issues
    • Removing all personal and valuable items from the vehicle
    • Ensuring the vehicle is accessible for service at the scheduled time
    • Providing accurate contact information for appointment coordination
    • Complying with all facility rules and safety requirements

    7. Service Guarantees and Warranties

    7.1 Workmanship Guarantee

    We stand behind the quality of our work. If you are not satisfied with our service, please contact us within 7 days of service completion so we can address any concerns.

    7.2 Product Warranties

    Ceramic coating and other protective products come with manufacturer warranties. Warranty terms vary by product and are subject to proper maintenance and care instructions. Warranty claims must be made in accordance with manufacturer guidelines.

    7.3 Warranty Exclusions

    Warranties do not cover damage caused by accidents, improper care, automatic car washes, harsh chemicals, or failure to follow recommended maintenance procedures.

    8. Intellectual Property

    All content on our website, including text, graphics, logos, and images, is the property of Upscale Detailz LLC and protected by copyright and other intellectual property laws. You may not use, reproduce, or distribute any content without our express written permission.

    9. Photography and Marketing

    We may photograph vehicles before and after service for quality control and marketing purposes. By using our services, you consent to such photography and the use of these images on our website, social media, and marketing materials. If you do not wish your vehicle to be photographed, please inform us in writing before service begins.

    10. Dispute Resolution

    10.1 Informal Resolution

    In the event of any dispute, we encourage you to contact us first to seek an informal resolution.

    10.2 Arbitration

    Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Scottsdale, Arizona.

    10.3 Class Action Waiver

    You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

    11. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, UPSCALE DETAILZ LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR GOODWILL. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE SPECIFIC SERVICE IN QUESTION.

    12. Indemnification

    You agree to indemnify and hold harmless Upscale Detailz LLC and its employees from any claims, damages, or expenses arising from your use of our services or violation of these Terms of Service.

    13. Governing Law

    These Terms of Service shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions.

    14. Severability

    If any provision of these Terms of Service is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

    15. Changes to Terms

    We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after any changes constitutes acceptance of the new Terms of Service.
